AN ORDER DESIGNATING BRYAN EPHRAEM E. MIGUEL AS THE DATA PROTECTION OFFICER (DPO) OF THE MUNICIPALITY OF CATEEL

WHEREAS, Republic Act No. 10173, otherwise known as the Data Privacy Act of 2012, aims to protect the fundamental human right to privacy while ensuring the free flow of information to promote innovation and growth;

WHEREAS, Section 21 of the Implementing Rules and Regulations (IRR) of the Data Privacy Act of 2012 requires Personal Information Controllers (PICs) in both the public and private sectors to appoint a Data Protection Officer who shall be accountable for ensuring compliance with applicable laws and regulations for the protection of data privacy and security;

WHEREAS, the Municipality of Cateel, as a Personal Information Controller, collects and processes personal and sensitive personal information of its constituents and employees in the course of delivering public services and performing governmental functions;

WHEREAS, it is imperative for the Municipality to ensure the security and confidentiality of personal data it processes, in accordance with Section 11 of the Act, which mandates that personal information must be processed fairly and lawfully, collected for specified and legitimate purposes, and retained only for as long as necessary;

WHEREAS, the designation of a qualified and competent Data Protection Officer is necessary to uphold the Municipality’s compliance with the provisions of the Data Privacy Act of 2012 and to promote a culture of privacy among its departments and offices;

NOW, THEREFORE, I, Emilou C. Nuñez, Mayor of the Municipality of Cateel, by virtue of the powers vested in me by law, do hereby order the following:

Section 1. Designation

BRYAN EPHRAEM MIGUEL is hereby designated as the Data Protection Officer (DPO) of the Municipality of Cateel effective immediately.

Section 2. Duties and Responsibilities

As the designated DPO, Mr. Bryan Ephraem Miguel shall:

  1. Ensure compliance of the Municipality of Cateel with the Data Privacy Act of 2012 and its Implementing Rules and Regulations;
  2. Inform and advise municipal offices and employees about their obligations under data protection laws;
  3. Monitor the Municipality’s compliance, including the assignment of responsibilities, awareness-raising, and training of personnel involved in processing operations;
  4. Serve as the contact person for data subjects on privacy-related matters and for coordination with the National Privacy Commission (NPC);
  5. Perform other tasks and responsibilities as may be assigned by the NPC and the Mayor in relation to data privacy and protection.

Section 3. Support and Resources

All municipal departments and offices are directed to fully cooperate with and support the Data Protection Officer in the performance of his duties. The necessary resources and logistical support shall be provided to enable the DPO to effectively fulfill his responsibilities.

Section 4. Effectivity

This Executive Order shall take effect immediately upon signing.
